Employee on Intermittent FMLA
What is an employer to do should they experience an employee who is on intermittent FMLA and taking more time off than expected? We recommend to review the medical certification, and if there has been a lapse in time and more time off is being used toward FMLA, to initiate a conversation with the employee to determine if there has been a change to warrant the additional time. Further, the employee may request a re-certification, converse with the medical provider (as long as it’s done by the direct supervisor), and/or request a second opinion at the employer’s cost.
